General Terms and Conditions of Rental and Use

I. General Rental Terms and Conditions

Preamble

These general terms and conditions govern the relationship between the owner and the individual tenant concerning the rental of real estate properties.

Article 1 — Content and Scope of Application

The conditions express the full obligations of the parties for the rental of the designated properties.

Article 2 — Property Designation

The owner offers three establishments:

  • Le Manoir de la Rulette, 118 Grand Rue, 6730 Tintigny
  • Le Zythogite, 51 Rue du Tilleul, 6730 Tintigny
  • Le Pavillon de l'Herboriste, 51 Rue du Tilleul, 6730 Tintigny

Capacity: 6 to 23 persons maximum. All rented furnished.

Equipment provided: jacuzzi, ping-pong table, barbecue, outdoor tables, reception rooms (subject to availability).

Not provided: bed covers, duvets, pillowcases, bath towels, kitchen linens. These options can be purchased via the shop /shop.

Article 3 — Rental Duration

Minimum duration: one night, according to reservation. Weekends cover Friday to Sunday at minimum, unless otherwise indicated in the offer.

Article 4 — Financial Terms

The price is firm and final, as set on the date of reservation. It includes cleaning fees. Furniture is provided on loan.

A security deposit (guarantee) is paid upon arrival and returned after the exit inspection, less any damages.

Article 5 — Reservation Cancellation

  • By the tenant: non-refundable.
  • By the owner: full refund of the total amount.

Article 6 — Arrival and Departure

Arrival: from 4:00 PM. Automatic code provided on arrival day.
Departure: 11:00 AM. The door locks automatically.

A "late departure until 5:00 PM" option is available on Sunday only (paid option on /shop).

Article 7 — General Obligations

The owner commits to:

  • Provide accurate and complete information;
  • Ensure peaceful enjoyment of the premises;
  • Be covered by liability insurance.

The tenant commits to:

  • Occupy the premises for personal use;
  • Enjoy the premises as a "prudent person";
  • Maintain the premises and keep them in good condition;
  • Report the presence of pets; they remain responsible for any damage they cause;
  • Insure against rental risks (fire, explosion, water damage);
  • Report malfunctions and incidents within 24 hours;
  • Respect neighbors' peace and quiet. No noise between 10 PM and 7 AM;
  • Groups of young people under 25 years old: not permitted;
  • Bachelor or bachelorette parties: prohibited.

Article 8 — Liability

The owner is not responsible for theft or damage to the tenant's personal belongings.

Any damage caused by the tenant shall result in compensation. The owner may claim:

  • The cost of repair or replacement of damaged items;
  • Additional cleaning fees for excessive dirt or damage.

Article 9 — Communication

Documents, data and information exchanged electronically constitute "admissible, valid, enforceable evidence with the probative force of a private deed". The parties accept the legal validity of these electronic formats.

Article 10 — Personal Data Processing

The owner complies with GDPR (EU Regulation 2016/679 of April 25, 2016). Processing is described in the privacy policy.

Article 11 — Miscellaneous Provisions

Non-exercise of a right does not constitute future waiver.

A clause that is null under applicable law or a court decision remains unwritten; the other clauses retain their validity, unless the invalid clause was substantial and undermined the contractual balance. The parties undertake to agree on a new provision replacing the one declared null.

Article 12 — Applicable Law and Jurisdiction

These conditions are subject to Belgian law. Disputes fall under the jurisdiction of Belgian courts.

Article 13 — Modification of General Terms

The owner may modify the clauses at any time without justification.

II. Electric Vehicle Charging

Charging electric cars is prohibited. There is no charging station on site; use of the house outlets is prohibited. Public charging stations are available nearby.

A fee of €125/day may be claimed in case of non-compliance.

III. General Terms of Use

Article 1 — Definitions

  • Listing: textual and visual data hosted on the site relating to a rental offer.
  • Real estate property: building for which the owner has ownership/enjoyment and authorization to offer for rent.
  • Tenant: internet users with whom the owner can enter into contact regarding listings.
  • Owner: person having ownership/enjoyment of the properties offered.
  • Service: consultation of the listings database.
  • User: potential internet users interested in booking properties.

Article 2 — Purpose

The Terms and Conditions define the conditions under which the owner makes listings available and allows booking requests and online payment.

Article 3 — Site Access

Access implies acceptance of the Terms and Conditions. Consultation of listings is free. No account creation or password required. All access costs are the exclusive responsibility of the user.

Article 4 — Maintenance

The owner may interrupt site access for maintenance. The user is notified if possible. In case of technical difficulty: contact reservations@gites-gaume.be.

Article 5 — Price

The displayed price corresponds to the rental amount as entered and modified by the owner at their responsibility.

Article 6 — Booking

Select a property, enter the dates and number of occupants.

Online payment is mandatory via a secure banking module (Stripe). Accepted payment methods are credit card (Visa, Mastercard, American Express), as well as bank transfer which blocks the booking for 3 days pending receipt of payment.

Payment is conditional on acceptance of the Terms and Conditions and cancellation conditions.

Article 7 — Booking Cancellation

  • By the tenant: conditions detailed in section I (General rental conditions).
  • By the owner: full refund of the total booking amount.

Article 8 — Communication

Emails to the owner must contain serious booking requests. The tenant accepts that documents exchanged electronically constitute "admissible, valid, enforceable evidence having the probative force of a private deed". The parties undertake not to contest the validity of these electronic formats.

Article 9 — Liability

The user is solely responsible for their use of the site and the data communicated. The site may experience limitations or delays related to the Internet; the owner disclaims all responsibility for these delays or damages.

The owner does not guarantee:

  • Security, continuity, absence of errors or compatibility;
  • That the site will meet the user's requirements;
  • Absence of errors or correction of defects;
  • Absence of viruses or dangerous components on the servers.

The site may contain hyperlinks. Content accessible via these links is not published by the owner, who has no rights over this content.

Article 10 — Force Majeure

The owner is not responsible for delay or failure to perform services due to force majeure (unforeseeable, insurmountable, external event). Recognized cases include: power failure, telecommunications failure or sabotage, network or Internet transmission failure or interruption, computer hacking, fire, flooding, storm, explosion, earthquakes, natural disasters, water damage, exceptional weather, epidemic, riot, war, insurrection, attack, vandalism, strike, lock-out.

Article 11 — Intellectual Property

The site, its distinctive elements, the content of listings and photographs of properties are protected by intellectual property and copyright laws. Copyright is held by the owner. No license or authorization is granted. No total or partial reproduction is permitted without prior written authorization.

Article 12 — Processing of Personal Data

The owner complies with the GDPR (EU Regulation 2016/679 of April 25, 2016). The terms are detailed in the personal data protection policy.

Article 13 — Cookies

The site uses cookies to analyze user navigation. Information in the cookie management policy.

Article 14 — Miscellaneous Provisions

Article 15 — Applicable Law and Jurisdiction

These conditions are subject to Belgian law. Disputes fall under the express jurisdiction of Belgian courts, failing amicable agreement.

The owner may modify the clauses at any time without justification.
